Disclaimers of Estar Travel & Tour Inc

 On your behalf, we make arrangements with airlines, hotels, cruise lines, transfer companies and other independent suppliers to provide you with the services you have purchased. We exercise due care in selecting these suppliers and pay particular attention to their reputation and reliability. However, we do not control these suppliers and thus, we cannot be held responsible for their performance or lack thereof. Our Agency as the tour operator and/or our agents will not issue any refunds and shall not be held responsible for any claims, losses, damages, costs or expenses arising out of personal injury or death, loss, damage or delay of baggage or other property, delay, loss of enjoyment, inconvenience, upset, disappointment, distress or frustration whether physical, emotional or mental, resulting from or arising out of any of the following: i. Any act or omission (including, but not limited to, inability or failure to provide services and/or products) by any customer, supplier or third party including, but not limited to, the airlines, transportation companies, coach tour operators, car rental organizations, excursion providers, hotel/resort properties, or anyone for whom such suppliers or third parties may be in law responsible; ii. An act of God or Event of Force Majeure; iii. Equipment failure iv. Sickness/illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.), family emergencies, theft or any other circumstance affecting you beyond our direct control; v. Failure of the passenger to obtain the necessary documentation or meet the required health regulations in order to complete their travel arrangements; vi. Failure of the passenger to follow instructions including, but not limited to, airport departure times, baggage handling and check-in time frame stipulated by Sunwing in these Terms and Conditions on the day of departure whether due to missed connections, adverse weather conditions, mechanical failures or any other reason whatsoever; vii. Voluntary participation in an optional tour, excursion or activity; viii. The need for us to cancel services, change itineraries or substitute accommodations or services, provided that efforts are made to supply comparable services and accommodations available; or ix. Cancellation of an optional tour, excursion or activity While every effort has been undertaken to ensure accuracy, any photographs, artist’s renderings and written descriptions appearing on this website are representational only and are not a guarantee that everything at the resorts or in the destinations will be exactly as depicted. 

Our Agency is acting only in the capacity of agent for tour operators, hotels, restaurants, airlines, bus companies, cruise shipping lines or travel insurance companies providing tours, transportations, hotel accommodations, meals, cruising, travel insurance and other services. Our Agency is not liable for any injury, death, loss or damage of personal property resulting from the use of the services. If the services included in the tour cannot be supplied or there are changes in an itinerary for reasons beyond the control of us, we will arrange for the provision of comparable services. Any resulting additional expenses will be payable by tour participants. Purchase of travel insurance is strongly recommended. Trip cancellation insurance and out-of-province health insurance were offered. Terms and Conditions of the booking and price are subject to the rules of the Service Provider and their interpretation of these rules. Cancellation/Change policy and further Terms and Conditions may be found in the Service Provider’s brochure or website or by contacting us. Please review your itinerary to ensure that all information is correct. For flights, please check in 3 hours  prior to departure. Please note that flight times are subject to change. Please re-confirm flight times prior to departure. This contract permits price increases. No price increases are permitted after the customer has paid in full. If the price increase is more than 7% (except for increases resulting from an increase in retail sales tax, federal Goods and Services Tax or Harmonized Sales Tax), the customer has the right to cancel the contract. Please visit the Service Provider's website or below websites or other official websites for information about your destination and your travel requirements including Health Conditions and Travel Documents needed to visit the destination country and return to Canada. We will assume no responsibility whatsoever for passenger(s) denied carriage by the airline or refused entry into any country. Canadian Citizens must carry a valid Canadian Passport. Canadian citizens can contact Foreign Affairs Canada at www.travel.gc.ca for assistance in obtaining this information. Non-Canadian Citizens please contact the relative Tourist Board or Consular Office before booking.  Please note that several countries now require that your passport be valid for up to six months after the completion of your travel in order to be accepted by them as a valid travel document. If your passport is damaged in any way, you could be denied boarding and you will be responsible for all costs associated with a new passport and a replacement holiday. Please note that entry to another country may be refused even if the required information and travel documents are complete as travel documentation is subject to change. If a parent is traveling alone with a child, that an affidavit or letter from the other parent may be required. Living standards and practices at the destination and standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada.
